Our client has been in practicing law for over 30 years.  As one of the premiere business law firms, with close to 100 attorneys, they have multiple offices around the US. They seek an IP Associate with 5-6 years of experience working in a hybrid setting out of their NYC Office (4 days a week in the office).

The firm’s proceedings are in the Federal District Courts, Circuit Courts of Appeal and State Courts throughout the U.S. as well as proceedings before the International Trade Commission and in the United States Patent and Trademark Office

MAIN RESPONSIBILITIES:

·       Proven track record of drafting and negotiating sophisticated agreements related to intellectual property, licensing (tech and non-tech), data privacy, IP asset sales and commercial transactions. (Emphasis on fashion, GPG and tech.

  •  Familiarity with financing transactions (equity and debt), merger and acquisition, joint   venture, and other strategic transactions is preferred.

·       Have direct client contact, conduct depositions, and make court appearances.

·       Involved in all aspects of IP litigation from inception through trial and appeal. Cases include trademark, patent, copyright, unfair competition, trade secret.

·       Work closely with partners and will be a key member of the team, and assume responsibility, including significant client contact, for a wide variety of IP related work. The ideal candidate will have experience in a significant portion of the areas listed below with an interest in expanding into other specialties listed below, including:

Ø  Federal court litigation on trademark, copyright, trade dress, rights of publicity, trade secret, false advertising, and unfair competition

Ø  Draft pleadings, plus responding and arguing motions

Ø  Prepare expert reports and assisting with discovery

Ø  Handle settlement strategies (mediation and dispute resolution)

Ø  Conduct UDRP proceedings and T.T.A.B. litigation

Ø  Trademark clearance, filing strategy, prosecution, and enforcement domestically and globally

Ø  Manage global trademark portfolios and advising on copyright issues

Ø  Conducting advertising copy review, including addressing comparative advertising, unfair competition, and NAD/BBB matters

Ø  Advising clients on rights of privacy and publicity issues

MAIN REQUIREMENTS:

·       Membership in good standing in the New York State Bar, a minimum of 5 years of IP litigation experience

·       Be present in the NYC office at least 4 days per week. Travel as needed.

 Salary range for this position is $200K - $220K, depending on years of experience and billable hour requirement is 1900. Solid benefits.
